DNA test: Eric Garner’s Legacy will be a million-dollar baby

Legacy is the name of a 1-year-old girl, who is set to receive the largest share of a huge wrongful death suit payout from New York city. She has been confirmed as the biological daughter of Eric Garner, who was killed when police placed a chokehold on him, by a DNA test.

The DNA tests have vindicated Legacy’s mother Jewel Miller who was in contention with some members of Garner’s family who were questioning Legacy’s paternity. Jewel Miller was Garner’s girlfriend, and she said that Legacy has been shunned by the Garner family.

Garner’s wife Esaw Garner has four biological children with Eric, and they are entitled to receive portions of money received from the wrongful death suit. But since they are much older than Legacy they are likely to receive a lesser share than her as she is likely to receive the largest share because she is the youngest heir. Courts apportion money based on life expectancy and needs of the child. Since some of Esaw’s children are adults and others are above the age of 15, they are likely to receive a minimum share from the settlement.
